- The Tenth Amendment states the Constitution's principle of
federalism by providing that powers not granted to the federal
government by the Constitution (that is, not prohibited by the
Constitution) granted to the states and the people, thus able to
guarantee state and personal rights
Drafting and Adpotion
• - The Tenth Amendment is similar to the Articles
of Confederation:
• "Each state retains its sovereignty, freedom, and
independence, and every power, jurisdiction, and
right (which is not by this Confederation
expressly delegated to the United States) in
Congress assemble…”
-When he introduced the Tenth Amendment in
Congress, James Madison explained that many
states were eager to ratify this amendment,
despite critics who deemed the amendment
superfluous or unnecessary

Printz vs. United States:

Brady Handgun Violence Prevention Act provisions require the
Attorney General to establish a national system for instantly checking
prospective handgun purchasers' backgrounds

Petitioners claimed that the background check is unconstitutional
since it violates personal rights.

However, the judges reversed this case since they did not find this
unconstitutional, since the constitution did not reserve this right to the
citizens.
But Why Us?
• - All the Americans are effected in some way by the 10th
Amendment every day. Since we are all live in a state, rights not
enumerated to the national government has to be guaranteed to the
citizens and the state government (which do make everyday
decisions that effects our life).
• - People are deeply concerned about the state's rights and theirs.
Again, since the states do make decisions that changes our life; we
have power to make decisions to differ the course of my life.
• - The rights of the states and the people had been a problem since
the constitution has been established. Many has argued for a weaker
central government, thus guarantees further state rights and citizen
rights.
• - A ton of money, time, congress session, and court cases deals with
the issue of state rights. The Obamacare (some argued that is
unconstitutional due to its approval ignores state rights) alone has
spent over 500 million dollars.
The Current Events?




- There are indeed currently lots of discussion
concerning Obamacare, and unsurprisingly the
rights of the states are mentioned. Since most states
senators and state executives are Republicans, the
majority of them favor the repeal of the law. This led
32 states representing 117 million Americans against
Obamacare.
- According to the Rasmussen Report, 52% of
Americans actually favor the repeal of Obamacare.
However, as the Republican-led congress and states
continuously clash with the Democratic Executive; it
would be extremely difficult for any progress at
repealing this law to form.
