University Apartments
UNIVERSITY OF CALIFORNIA, LOS ANGELES
1. PARTIES. The parties to this Contract (“Contract”) are The Regents of the University of California (“University”) and the
undersigned student (“Student”).
2. TERM. The term of this Contract shall be for the 2009-2010 Academic Year, and the dates of occupancy shall be as
specified in the Housing Offer, incorporated herein by reference. By signing below, Student is agreeing to be bound for
the entire term of this Contract. This Contract, properly executed, shall be effective on the date the first payment required
by the Housing Offer is received and accepted by the University.
3. UNIVERSITY SHALL:
a. Provide Student with a furnished room or apartment (which may be occupied by one to four residents) within a
UCLA University Apartment for the term of this Contract. University, at its sole discretion, reserves the right to
utilize single rooms for a single, double or triple occupancy as well as the right to reduce the number of residents
per room as space becomes available. The terms and conditions set forth herein apply to all apartments which are
occupied by one to four residents.
b. Provide cleaning service for common areas (hallways, stairwells and garages) of the University Apartment
buildings.
c. Provide in-room/apartment computing services as described in Appendix B, attached hereto and incorporated
herein.
4. STUDENT SHALL:
a. Be a regularly enrolled, single, full-time student, as defined by the Registrar’s Office, for the term of this
Contract.
b. Pay Housing Fees in accordance with the dates and amounts specified in the Housing Offer.
c. Move into the assigned room not later than 12:00 p.m. the first day of classes each quarter. If Student cannot
move in by this day, Student agrees to furnish prior written notice of late arrival to the Housing Assignment
Office.
d. Not change, modify or alter the room or apartment, its fixtures, furnishings, equipment or decoration without the
written consent of the University Apartments Management.
e. Not assign this Contract or sublease the room or apartment, or use it in any other manner than as a personal
residence.
f. Abide by all University and University Housing rules and regulations, the University Apartments Student
Resident Handbook, University Apartments Rules and Regulations, and amendments thereto as adapted and
published from time to time and available on the web at www.housing.ucla.edu/uahandbook, as well as all
applicable local, state and federal laws, the totality of which are incorporated herein by reference. The
University Apartments Rules and Regulations are listed in the University Apartments Student Resident
Handbook for the convenience of the Student. Violations of the rules and regulations or any laws may form the
basis for disciplinary action against Student, which may include termination of the Contract and initiation of
eviction proceedings.
g. Leave the room, apartment and its furnishings in clean and orderly condition at the termination of this Contract.
h. Not perform or arrange for non-UCLA staff to perform any repairs to damages or any corrections of deficiencies
in the premises whether during or upon the termination of Student’s tenancy. The foregoing shall not limit
Student’s right to request that University repair damage, correct deficiencies, or otherwise service the premises
during the tenancy. Student shall be liable for any damage done to the premises or deficiencies created by the
Student. Normal wear and tear is excepted.
i. Be obligated for the entire length of this Contract.
j. Not use the apartment in any other manner than as a personal residence. Occupancy is limited to Student and
Student’s roommate(s), if any, with whom the University has a separate Contract.
5. PARKING: A random priority and availability determine parking for University Apartment residents; parking availability
is not guaranteed. A random priority number is assigned when a student applies for housing. Parking fees are billed in
accordance with the Housing Offer.
6. INVENTORY & DAMAGE REPORT: Within three days after obtaining a key, Student shall complete and sign an
Inventory and Damage Report which shall then be deemed incorporated into this Contract. Failure to complete and return
the Inventory and Damage Report within the time specified shall be construed as acceptance by Student of the inventory
list at time of receipt of keys as an accurate inventory of the room and apartment contents, meaning that Student found no
reportable damage other than normal wear and tear and that Student accepts responsibility for any damage that may be
discovered thereafter.

2. 7. AUTHORIZED OCCUPANT - GENDER: Single student apartments may be shared only by roommates of the same
gender.
8. TERMINATION.
a. University may terminate this Contract and all attendant rights of occupancy upon 30 days of notice to Student.
Student may be subject to a three day notice to perform covenant or quit, to pay rent or quit, or a notice to quit,
whichever is appropriate, under any circumstances allowed by law, including the following:
i. If Student ceases to be a registered student as a result of graduation, transfer, withdrawal or dismissal, or
ceases to be eligible for single student housing as a result of marriage.
ii. Failure to comply with the Contract and/or University Housing regulations (as stated in the University
Apartments Student Resident Handbook).
iii. Failure to make required payments in accordance with the Housing Offer.
iv. Failure to comply with any applicable state and/or federal law which are incorporated herein by
reference.
b. This Contract may be terminated by Student with written approval of University. In the event of University
approval, the effective termination date will be the date University approval is granted. Student shall remain
responsible for all room charges until the termination date. Student shall be entitled to a refund of a pro-rated
room charges for any such charges paid beyond the effective termination date, less any outstanding amounts
owed as allowed by law, provided Student, if in residence, has completed the established checkout procedure.
Students who withdraw or are dismissed from the University must see University Apartments Management to
obtain a Contract Termination Referral Form.
c. It is Student’s responsibility to furnish the Housing Assignment Office with evidence of dismissal from the
University within seven days of the effective date of dismissal. In the event of marriage, Student must present a
marriage certificate; this Contract will be terminated on the date that evidence is presented to the Housing
Assignment Office if the marriage ceremony occurs during the term of this Contract.
d. This Contract will be terminated if Student fails to attend the University for any quarter during the term of this
Contract in which Student has contracted to be an occupant of University Housing. Written notification of
nonattendance must be submitted to the Housing Assignment Office. In the event notification of nonattendance is
received after the housing opens, a prorated charge will be made for room to the date written notification is
received by the Housing Assignment Office.
e. Contract Termination Fee: A Contract Termination Fee shall be paid by Student if terminating his or her
Housing Contract, unless the Contract is terminated as a result of circumstances beyond his or her control as
determined by the University in its sole discretion. The Contract Termination Fee may also be waived upon
approval of the Director of Housing Services based upon compelling and unanticipated medical or financial
problems arising clearly beyond the control of the Student. The Contract Termination Fee covers the
University’s administrative costs resulting from Student vacating or failing to occupy the apartment, is agreed to
be reasonable, and is accepted as the amount of liquidated damages caused by such circumstances because it is
at this time impractical and difficult to determine actual damages. The Contract Termination Fee is in addition
to any sums owed by Student for an unauthorized termination, such as, but not limit to, room fees until the end
of the contract term or until a replacement student can be found, and assumes occupancy of the unit. It shall be
Student’s responsibility to furnish University’s Housing Assignment Office with evidence of dismissal from the
University within seven days of the effective date of dismissal.
f. A Contract Termination Fee will be charged according to the following schedule:
i. $300 shall be paid by Student for any contract cancellation request received prior to 5:00 p.m. on July
31, 2009 for Fall Quarter; $400 shall be paid by Student for any contract cancellation request received
after 5:00 p.m. on July 31, 2009 for Fall Quarter.
ii. $300 shall be paid by Student for any contract cancellation request received prior to 5:00 p.m. on
October 13, 2009 for Winter Quarter; $400 shall be paid by Student for any contract cancellation
request received after 5:00 p.m. on October 13, 2009 for Winter Quarter. For new Winter Quarter
contracts, $300 shall be paid by Student for any contract cancellation request received prior to 5:00
p.m. on December 11, 2009; $400 shall be paid by Student for any contract cancellation request
received after 5:00 p.m. on December 11, 2009. Requests for termination of the contract must be
received prior to 5:00 p.m. on the last business day prior to the start of the contract.
iii. $300 shall be paid by Student for any contract cancellation request received prior to 5:00 p.m. on
January 26, 2010 for Spring Quarter; $400 shall be paid by Student for any contract cancellation
request received after 5:00 p.m. on January 26, 2010 for Spring Quarter. For new Spring Quarter
contracts, $300 shall be paid by Student for any contract cancellation request received prior to 5:00
p.m. on March 19, 2010; $400 shall be paid by Student for any contract cancellation request received
after 5:00 p.m. on March 19, 2010. Requests for termination of the contract must be received prior to
5:00 p.m. on the last business day prior to the start of the contract.

3. g. In the event of dismissal, withdrawal from the University, or exclusion from On-Campus Housing due to
disciplinary action, Student shall vacate the assigned room within 48 hours of receiving notification of
exclusion from, or ineligibility for, University Housing, as applicable. Student shall remain responsible for all
room and board charge up until the date student is asked to leave. A prorated charge will be made for room and
board until the date the Student vacates, provided Student, if in residence, and has completed the established
checkout procedures. In addition, the Contract Termination Fee will be charged.
9. IT IS FURTHER AGREED THAT:
a. University may enter Student’s room or apartment during operational working hours for cleaning, maintenance,
and/or any reason allowed by law, including to make repairs, alterations, or facility improvements to ensure
compliance with Housing and health and safety regulations, or in the event of an emergency, building
evacuation, or abandonment of the room or apartment by Student or Student’s roommate(s). Prior notice of such
entry will be given to the Student or Student’s assigned roommate(s) except in cases of emergency, abandonment
or where impractical.
b. A $25.00 late charge shall be assessed for each delinquent installment payment and each month it remains
delinquent. Failure to make a payment will result in record restriction. Due dates for payments are set forth in the
Housing Offer. Such charge is agreed to be reasonable and is accepted as the amount of liquidated damages for
each delinquent payment because at this time it is impractical and difficult to determine the added costs to
University resulting from a delinquent payment.
c. The cost of any loss or damage to the facility or its fixtures, furnishings, equipment or decoration, shall be
charged to Student if Student or Student’s guest is the cause of the loss or damage. Such cost shall be
determined by University in its sole discretion and payment shall be made by Student and be due upon receipt of
the notice. In the event the cause of any loss or damage to the facility or its fixtures, furnishings, equipment or
decoration cannot be determined after reasonable investigation by the University, the pro rata cost of such loss or
damage shall be charged to Student regardless of whether Student was present at the time the loss or damage
occurred.
d. University does not promise or guarantee Student an assignment to any particular room or apartment in
University Apartments. University may reassign or require Student to move to another room or apartment at
University’s sole discretion, which may result in an increase in Housing Fees.
e. University assumes no responsibility and provides no insurance or financial protection for Student’s personal
property. Renter’s insurance may be obtained from insurance companies; University does not offer renter’s
insurance.
f. A breach of this Contract by Student, including but not limited to by delinquency in payment, may result in any
or all of the following actions: administrative action against Student’s status at the University, record restrictions,
and initiation of termination of tenancy proceedings.
g. University may, at its sole discretion, increase the Housing Fees by up to 5% of the total charges in the event of
unusual and unforeseen circumstances, and modify the Housing Offer accordingly.
h. In the event of a vacancy in an assigned room/apartment, University will change individual contracts to match
the remaining occupancy level which will result in an increase in Housing Fees.
i. Upon termination of this contract, Student agrees to surrender the premises to the University and to remove all
property of the Student. Any property left in the apartment after vacating the unit shall be deemed abandoned,
and the University may take possession of and use or dispose of such property as provided by law.
j. In the event Student vacates the assigned room, student is required to return the assigned room and bath to its
original condition, reasonable wear and use excepted. Failure to do so will result in damages and cleaning
charges assessed to Student. In the event Student Roommate vacates a multi-resident unit, the University may
enter the Student unit during normal business hours upon twenty-four (24) hours’ written notice to conduct and
occupancy check to confirm the Student Roommate has moved out (vacated). See University Apartments
Resident Handbook for moving out.
k. In the event Student Roommate vacates the assigned room, Student and Student Roommate are required to return
the common areas of the apartment to its original condition, reasonable wear and use excepted. Failure to do so
will result in damages and cleaning charges assessed to Student and Student Roommate.
l. The Student and Student Roommate(s) may not bring pests into the unit, knowingly or not. In the event pests are
introduced to the unit by the Student or Student Roommate(s) and are deemed by the University a hazard to
health conditions in and the safety of the surrounding units, Student and Student Roommate(s) will be liable
financially for eradication measures, including, but not limited to, pest control and furniture and/or carpet
replacement. The University reserves the right to terminate this contract upon service of a Three-day (3-day)
Notice to Quit to address any infestation issues. In the event the University serves such as a 3-day notice, the
University is not liable for identifying, obtaining, or paying for alternate housing; rather, the foregoing is the
Student’s and Student Roommate’s (or Roommates’) responsibility and liability.
10. UTILITY SERVICE: Pursuant to Civil Code section 1941.4, University is responsible for installing one useable telephone
jack and for placing and maintaining the inside telephone wiring in good working order in residential dwellings. Student

4. is responsible for the telephone and any wiring between the telephone and the telephone jack as well as cost of service
and/or cost of installing a line(s). If there is a problem with telephone service, Student must first determine that the
problem is not in the telephone or the wiring running to the telephone jack; once it is determined the problem is not in
either, Student must notify the University Apartments North Maintenance Office, and the University will arrange for any
necessary repair of the telephone jack or inside wiring. Cost of repairs not under the responsibility of the University shall
be borne by the Student. The University agrees to pay for water, trash removal service, electricity and gas, as applicable.
11. WAIVER, MODIFICATION, NON-ENFORCEMENT: Any waiver or modification of the conditions of this Contract
shall be in writing signed by Student and an authorized representative of the University’s Housing Administration. Any
waiver or non-enforcement by University of any term or condition of this Contract shall not constitute a waiver of any
subsequent breach of the same or any other term or condition of this Contract. Acceptance by University of any rental
payment after Student’s breach of any provision of this Contract shall not be deemed a waiver of such provision or any
prior or subsequent breach of any provision, other than Student’s failure to make timely payment of the rental installment
so accepted, whether or not University knew of the prior breach at the time such rent was accepted.
12. CERTIFICATION. Student certifies that the statements made on the application in connection with this Contract are true
and correct. Falsification of these statements will render this Contract null and void. Student has read and understands the
terms and conditions of this Contract and the Housing Offer which are incorporated herein by reference.
13. Notice: Pursuant to Section 290.46 of the Penal Code, information about specified registered sex offenders is made available
to the public via an Internet Web site maintained by the Department of Justice at www.meganslaw.ca.gov. Depending on an
offender's criminal history, this information will include either the address at which the offender resides or the community of
residence and ZIP Code in which he or she resides.
14. RENT CONTROL: Student understands the University is exempt from provisions of any local rent control ordinances.
By signing below, the undersigned indicate that they have read this Contract in full, including any and all appendices and
documents incorporated by reference, and agree to be bound by its terms.

Appendix B: University Apartments In-Room/Apartment Computing Acceptable Use Policy
UNIVERSITY OF CALIFORNIA, LOS ANGELES
UCLA Housing provides internet services through Time Warner Cable affiliated cable operator ("Operator") to facilitate the sharing of
knowledge and information while supporting and enhancing the educational and research experience of the student. Access is a
privilege and requires that individuals act responsibly across all ISPs offered by Operator. To further that goal, Operator has
developed an Acceptable Use Policy. Operator takes these issues very seriously and will enforce its rules to ensure enjoyment by all of
its members. Operator reserves the right to suspend or cancel a subscriber's account for engaging in inappropriate conduct. Subscribers
remain legally responsible for any such acts. In using the services of any ISP as provided over Operator's cable network (the "ISP
Service"), subscribers accept this non-exhaustive list of restrictions as well as those set forth in Operator's Cable Modem Subscription
Agreement and agree to use the ISP Service only for lawful purposes and not to use or allow others to use the ISP Service in violation
of the following guidelines which presented herein is incorporated into the 2009-2010 University Housing Contract.
IT IS AGREED THAT:
1. This policy is adopted by the University and Operator for purposes of managing and controlling internet services made
available to students who reside in University Apartments, and may be modified or changed by the University or Operator at
any time without prior notice to, or agreement by, the Student.
2. The University and Operator shall provide residents of University Apartments with access to internet services provided by
the Operator. This service is provided for students’ educational, research, and incidental personal, non-commercial use only.
The service cannot be used for any enterprise purpose whatsoever whether or not the enterprise is directed toward making a
profit.
3. The ISP Service may not be used to engage in any conduct that interferes with Operator's ability to provide service to others,
including the use of excessive bandwidth.
4. The ISP Service may not be used in a manner that interferes with Operator's efficient operation of its facilities, the provision
of services or the ability of others to utilize the ISP Service in a reasonable manner. Operator may use various tools and
techniques in order to efficiently manage its networks and to ensure compliance with this Acceptable Use Policy (“Network
Management Tools”). These may include detecting malicious traffic patterns and preventing the distribution of viruses or
other malicious code, limiting the number of peer-to-peer sessions a user can conduct at the same time, limiting the aggregate
bandwidth available for certain usage protocols such as peer-to-peer and newsgroups and such other Network Management
Tools as Operator may from time to time determine appropriate.
5. The ISP Service may not be used to breach or attempt to breach the security, the computer, the software or the data of any
person or entity, including Operator, to circumvent the user authentication features or security of any host, network or
account, to use or distribute tools designed to compromise security, or to interfere with another's use of the ISP Service
through the posting or transmitting of a virus or other harmful item to deliberately overload or flood that entity's system.
However, the University and Operator, in general, cannot assure complete electronic security or privacy for personal
computing. It is important that each individual take reasonable security and privacy precautions to protect against computer
viruses and other computer attacks which may result in loss of data, unintentional release of personal information, or negative
impact on the services and facilities for others.
6. In using the ISP Service, Student may not use an IP address or client ID not assigned to you, forge any TCP/IP packet header
or any part of the header information in an e-mail or newsgroup posting or probe, scan or test the vulnerability of any system
or network by the use of sniffers, SNMP tools or any other method.
7. The ISP Service may not be used to post or transmit content that violates child pornography statutes or contains graphic
visual depictions of sexual acts or sexually explicit conduct involving children, or other depictions of children, the primary
appeal of which is prurient. Complaints regarding the posting, distribution, or availability of child pornographic material
should be submitted to childporncomplaints@rr.com.
8. The ISP Service may not be used to upload, post, transmit or otherwise make available any materials or content that violate
or infringe on the rights or dignity of others. These include, but are not limited to, materials infringing or compromising
intellectual property rights or the ability to maintain trade secrets and other personal information as private; the ability to
avoid hate speech; threats of physical violence; harassing conduct; sexually oriented material that is offensive or
inappropriate; and unsolicited bulk e-mail.

6. 9. The ISP Service may not be used to engage in or foster any consumer fraud such as illegal gambling, “Make Money Fast”
schemes, chain letters, Pyramid, or other investment schemes, or to make or encourage people to accept fraudulent offers by
e-mail, USENET or other means, of products, items or services, originating from your account, or through a third party which
implicates your account or to post or transmit off-topic or commercial messages on bulletin boards
10. The Student shall abide by all applicable laws (state and federal) and University policies. Civil and criminal penalties may
also result from violation of Federal and State law.
11. Examples of misuse include, but are not limited to, the following:
a. Using a computer, computer account, or system (including scanning systems for security loopholes, user accounts,
passwords, etc.) without authorization.
b. Knowingly performing an act that will interfere with, damage, or otherwise degrade the normal operation of other
systems and/or network resources, including but not limited to, running, installing or distributing programs known
as computer viruses, Trojan Horses and worms.
c. Attempting to monitor or tamper with another entity’s electronic communications.
d. Attempting to circumvent data protection schemes or security mechanisms.
e. Misrepresenting your identity to avoid accountability (e.g. falsifying your e-mail address).
f. Using another’s computer account identity.
g. Violating terms of applicable software licensing agreements or copyright protection laws, including making
available of materials such as music, videos, texts or software without appropriate permission.
h. Taking any action that invades the privacy of individuals or entities that are creators, authors, users, or subjects of
information resources.
i. Violating any state law or regulation, or University codes of conduct.
j. Using the network for commercial purposes or charging for any service provided across the network.
k. Using an unauthorized IP address or statically assigned address without approval.
l. Using electronic mail, services, or facilities to harass others, including, but not limited to, sending unsolicited mass
mailings over the network (chain mail, solicitations, etc.).
You may not engage in any of the above activities using the service of another ISP, while channeling such activities through
your ISP Service account or using this account as a mail drop for responses.
