OBJECTIVES
Essential notions of Administrative Law, Public Administration, Administrative Organization and their material,
functional and legal limits. Knowledge of the rules and legal instruments of the Administration to prosecute
public interest, like contracts and administrative acts. Most important fact that students most understand is the
«escape of the Administration to the private law» and consequences- social, economic and legal type. Another
essential aspect oh this discipline is the procedimental phases that form «administrative and public contracts».
LEARNING OUTCOMES
knowledge of administrative law (CPA, CRP, CPTA, CCP) and the correspondent notions and legal terms and
the most important principles of administrative activity.

I PART – Administrative Contracts (in Portugal)
1. The «procurement» and the public contracts in Portugal
1.1. European influence: public contracts in portuguese law
1.1.1. Essential principles that discipline our contracts
2. Contracts in Public Law
2.1. Concept: a) public contract; b) administrative contract; c) civil contract (Civil Code)
2.1.1. Tipologies of public contract
2.2. Contract relating to the exercise of public powers
2.3. The contracts of private law celebrated by public entities.
2.4. The Legal regime: the new Code of Contracts (CCP).
2.4.1. The proceedings of formation of «public contracts». Legal analysis. Different types of the multiple phases.
