- Procurement regulations should impose two conditions with regard to the criteria which will be applied for determining the most economically advantegous tender. First is the principle of non-discrimination; second the criteria applied shall generate an economic advantage for the contrangting authority. The criteria applied should give the contracting authority discreation to compare objectively the different tenders and to accept the most advantageous on the basis of objective criteria. The question rises whether the concept of economically advantageous tender implies that each indiviual award criterion
