Mumbai Rape Case: Law and Legislation loosing battle to protect
women

anjali deokar | Women Empowerment | 201 3-09-1 6 1 1 :5 5 :47 |

Hydrabad -Student drugged, raped for a year ! We love to talk about how India is
developing, how the females in India are slowly and steadily claiming their rightful spot in
each and every aspect of life. How the people in India are becoming open-minded
towards women. But once in a while, we pick up a newspaper and sift through the pages
to find many horrible offences against them. We feel sorry for the victim and a corrosive
hatred towards the culprit(s). It seems like nothing apart from physically lynching the
culprit would satisfy our inner demon, and a few days later everything is forgotten and
we carry on with our lives. In a recent news, a 20 year old polytechnic student in
hyderabad was allegedly kidnapped and raped by the college canteen owner for almost
17 months. The victim went missing somewhere in April 2012. Though the parents of the
victim lodged a 'missing' complaint to a nearby police station, she was not traced. The
victim reportedly managed to escape from the crutches of the kidnapper and reached
home, where she narrated the ordeal she went through for the past 17 months to her
parents and the police. The accused was apprehended, was let off, and then arrested
again where he claimed that the girl was in love with him, and had eloped with him. The
police officials are verifying if the girl really eloped with the accused and later
approached the police after a fallout. Meanwhile, the victim said that she was raped
repeatedly everyday, and was able to escape when the accused fell asleep after getting
drunk......reallyy awakened ???

The much talked about and fought on food security bill was introduced in the Parliament
today by the Food Minister KV Thomas after withdrawing the previous ordinance. While
the debate regarding consultation with the states is still on, the Bill has raked another
debate posing the question of growth against redistribution as was witnessed in the
much publicised (and exaggerated) debate between India's two most well known
economists Amartya Sen and Jagdish Bhagwati. The contention that India's single
minded focus on pushing the GDP rate hasn't really widened the social base that
benefits from this growth. Moving ahead the debate regarding the Food bill seems to
have developed electoral connotations as well, especially in the aftermath of Sen's
comments regarding Modi. While Modi has been projected as the harbinger of economic
growth, Rahul contend's to be the voice of India's downtrodden. It is important we realise
the need of the hour, the levels of malnutrition and starvation in the country. While the
Food Security bill needs active debate and discussion, it is important the parties keep
the 2014 elections out of their minds and the needs of millions below poverty line in.

Cyber Security Policy: Treading into the Techno-Era

Our country is becoming increasingly vulnerable to cyber crime. Like in the United
States, the internet first boomed followed by online criminals and hackers. This is always
been the case. Similarly, in india where internet literacy is rapidly growing along with the
country''s economy its inevitable that someone abuses the luxury of literacy and
misuses the internet for immoral acts. Kapil Sibal and the government have released the
cyber security policy which I feel will definitely reduce the number of online crimes but
technology is growing faster than we are so there will always be new ways to break into
the 'system'.

SC pulls up Centre to regulate sale of acid

EXPERT OPINION

sharmila roa | Judiciary | 201 3-07 -22 09:5 0:5 9 |

India has become a scary place to live. Despite all our efforts, despite all the laws and
regulations we blindly depend on a system that fails to provide justice to thousands of
people. Think about how many rapists, serial murderers, corrupt politicians roam free in
our country without the modest sign of guilt or fear. This mentality of getting away with it
is what makes india one of the most unsafe places to stay. The government needs to
put an end to this by banning acid for household use altogether along with the 3 lakh
compensation . Nearly 3 victims every week succumb to their injuries due to acid
attacks.

"Having a foreign carrier such as
AirAsia come in, is a good sign.
They have experience, expertise,
good management - all of that - if
they bring it into the country, it
helps lift the entire industry."

National Food Security Bill: The long road ahead:
Prerna Trehan | Lok Sabha Bills | 201 3-07 -05 1 0:22:01 |

The Congress led government has decided to push in an Ordinance for the food
security bill. It is a master stroke by the Congress leaders as far as the electoral gains
are concerned but a sad day for Parliamentary Democracy. A Parliament is supposed to

be the house of representatives of the people meant to discuss and debate various
issues so as to take on board the views of every section of the society. However such
measures like the ordinance suggest that all that party politics has comes down to is
bagging the most number of votes. Without any discussion the Bill will remain a paper
tiger. It won't be able to rectify many of its flaws and at the end of the day become just a
rallying slogan for electoral victory, a la "Garibi Hatao". Poverty and starvation will only
go after concrete and workable measures are taken by taking into account the bigger
picture. The passing through of the Ordinance will make a hero out of the Congress and
opposition by not extending its support will emerge to be anti-poor and a villain.

Who was Ishrat Jahan?
Prerna Trehan | Tackling Corruption In India | 201 3-07 -03 1 0:29:5 8 |

The CBI's first charge sheet is out and the encounter has been termed as being staged
wherein 19 years old Ishrat along with three others were abducted and then killed in a
fake encounter and termed to be Lashkar members. Along with Gujarat state polce, IB
official stoo have been named who were involved in this murder and criminal conspiracy.
Such an incident is appalling and shakes the very foundations of a free, democratic
country where civil authorities played with lives of 4 citizens and further pushed their
families into a life of despair and agony. The CBI's work though commendable again is
an example of delayed justice that needed repeated reprimanding and orders from the
judiciary to put the work in order. It is important that a thorough investigation is carried
out so as to further identify state officials and others who were involved in this brutal act.

Add your comment... and now the CBI officer in charge investigating the case along with
the Special Public Prosecutor have received threats from anonymous sources leading
them to request for security. Hopefully the government will take adequate measures to
ensure that the investigation doesn't get hampered due to such acts. It is important that
they finally set an example and prosecute those involved.

Political Parties under RTI Act
Prerna Trehan | Tackling Corruption In India | 201 3-07 -02 1 0:20:37 |

The Government thinks of moving an ordinance to keep Political Parties out of the RTI
Act. Such a move will only lead to a violation of all that RTI stands for that is
encouraging transparency and accountability. If the Parties are so confident of their
character and patriotic fervour for the country they should be more than willing to
disclose information regarding certain activities and funds to the masses so even we
can take more informed decisions during the elections. The Association for Democratic
Reforms has brought out a Joint Statement in this regard: Joint Statement regarding
ordinance being passed to keep political parties out of the RTI: There are reports that
the Government is thinking of promulgating an ordinance to amend the Right to
Information Act. This Act was passed by our Parliament and has now become part of the
extremely valuable Citizen empowerment for our democracy. We appeal to Government
and all political parties to drop any consideration of amending the RTI Act. We are not
aware of any emergency requiring such an Ordinance, and are confident no such move
will be undertaken. 1.. Aruna Roy 2. Arvind Kejriwal 3. Prashant Bhushan 4. Anjali

Death of the Gentlemen
Prerna Trehan | Educating India | 201 3-06-26 1 0:25 :25 |

The ICC Champions Trophy and we are back to glorifying the Indian cricket and putting
a halo on he-can-do nothing-wrong Dhoni! Only if there was fervour about other sports
and sportspersons, India wouldn't put up such disappointing performances at the
Olympics! And while one or two persons may be banned, they will be back tomorrow as
commentators or may be MPs and the rest will go on as ever.

Uttarakhand floods: Man v/s Nature
Ajay Patel | Society | 201 3-06-26 1 0:01 :25 |

Its going to be an uphill task now for the special forces to contain the situation in
Uttarakhand now that hundreds of people have reported fever and diarrhea. The
decaying of dead bodies in Yamuna and Ganga have contaminated the water and if not
brought under control could pollute the water till west Bengal. One solution I would want
to advice to the people of Uttarakhand would be to follow the steps of Solar water
disinfection. The process involves filling up a water bottle till the top and laying it out in
the sun, preferably on top of a roof, for 4 hours. If the day is a bit cloudy then leave it
there for about 8 hours. This will kill all the harmful bacteria from the water and will be
safe to drink.

CBI: A Caged Parrot
Prerna Trehan | Tackling Corruption In India | 201 3-06-24 09:5 5 :43 |

Another example of the sad state of investigative agencies stands in front of the country

converted by Web2PDFConvert.com
with the ishrat jahan encounter case. There is questioning of the reliance of the
Intelligence Bureau information and the Gujarat State Police. Its been nine years and
yet the CBI's investigation regarding the authenticity of the encounter remains
incomplete. The Judiciary has time and again reprimanded for such lapses. Meanwhile
the dainted image of CBI also gives an opportunity to BJP to claim the entire inquiry to
be a hoax being conducted on the orders of the government in power. Its high time that
agencies stay clear of such political games and perform the function that they are
supposed and that is safeguarding the citizens of the country and ensuring the security
and integrity of one and all.

Fighting the Gag
Shweta Sindhu | Society | 201 3-06-1 3 1 0:1 2:38 |

Its completely horrifying to hear abt the lemp incident. Ive actually been there a couple
of times and each time I felt the service was crap! Maybe they've done up the place well
and play decent music but that is not all what makes a restaurant worth visiting again. I
dont think many of us will ever go there again and even if we do it would be to add fuel
to the fire that was sparked by the firstpost blog. Its an insult to our democratic rights
and anyone who turns a blind eye would be the biggest hypocrite. The incident is one
thing that could have been tamed from escalating on social media but the guy had the
audacity to come out in public and threaten anyone who uses social media against the
restaurant. Theres one thing to threaten a bunch of kids in ur bar and another to
threaten the very rights and values this country has been built on.

A tale of Twisted Reforms
Sumit Vadhva | Educating India | 201 3-06-1 2 1 0:02:1 9 |

Thats true but it will definitely not stop them from applying. Online registrations for
admission to undergraduate courses to DU colleges is fast catching up with offline
registrations as 56 thousand applications were filled over the internet as against 59,756
candidates submitting OMR forms. On Tuesday, the total number of registrations
exceeded one lakh. I guess even if some believe it is a repeat of class 12 its known to
have produced some of most intelligent minds in our country.

A tale of Twisted Reforms
Prerna Trehan | Educating India | 201 3-06-1 0 1 0:06:40 |

First the semester system and now the Four year programme. Delhi University is
supposed to set an example for many other universities in the country and by taking
such impulsive and ill thought out steps, it may lead to downfall rather than
improvement. There are eminent teachers and professors who are very much a part of
the University family who are protesting against this change. The addition of one year
also means paying extra and for economically under-privileged students this will lead to
additional burden. There has already been a hiking of fees in many colleges and with
hardly any hostels and lack of adequate infrastructure, many students have to take to
overpriced PGs and flats. How does the University plan on accommodating such
grievances. Instead of discouraging drop outs, this may lead to many students not being
able to join DU due to the additional expenses and spending another year just to
graduate. Also, students who want to want to pursue Masters degree in India but in
universities other than DU will be wasting a year.

Direct Cash Transfer Scheme begins in 20 Districts
Neeraj Joshi | Inside the Direct Cash Transfer Debate | 201 3-04-1 6 07 :07 :1 6 |

This is a great initiative taken by the government. This will at least reduce corruption
and will make sure money is directly transferred to beneficiaries and not worry about
corruption. However with an initiative of such magnitude needs planning and a lot of coordination with state governments. Is our government ready for it? Issuing Aadhaars to
millions of people as well as opening their bank accounts and then matching the 2 is an
extensive process. Jairam Ramesh and Nandan Nilekani will be addressing the National
Advisory Council (NAC) as well as members of media about the plans of the government
and how they will overcome various obstacles along the way. For example, the first
stage, identifying the Beneficiaries through the Aadhaar Scheme. The UIDAI and NPR
say 800 million aadhaars will be done in the next 15 months while 280 million have
already been issued.

We love to talk about how India is developing, how the females in India are slowly and steadily claiming their rightful spot in each and every aspect of life. How the people in India are becoming open-minded towards women. But once in a while, we pick up a newspaper and sift through the pages to find many horrible offences against them. We feel sorry for the victim and a corrosive hatred towards the culprit(s). It seems like nothing apart from physically lynching the culprit would satisfy our inner demon, and a few days later everything is forgotten and we carry on with our lives. In a recent news, a 20 year old polytechnic student in hyderabad was allegedly kidnapped and raped by the college canteen owner for almost 17 months. The victim went missing somewhere in April 2012. Though the parents of the victim lodged a 'missing' complaint to a nearby police station, she was not traced. The victim reportedly managed to escape from the crutches of the kidnapper and reached home, where she narrated the ordeal she went through for the past 17 months to her parents and the police. The accused was apprehended, was let off, and then arrested again where he claimed that the girl was in love with him, and had eloped with him. The police officials are verifying if the girl really eloped with the accused and later approached the police after a fallout. Meanwhile, the victim said that she was raped repeatedly everyday, and was able to escape when the accused fell asleep after getting drunk......reallyy awakened ??? While the debate regarding consultation with the states is still on, the Bill has raked another debate posing the question of growth against redistribution as was witnessed in the much publicised (and exaggerated) debate between India's two most well known economists Amartya Sen and Jagdish Bhagwati. The contention that India's single minded focus on pushing the GDP rate hasn't really widened the social base that benefits from this growth. Moving ahead the debate regarding the Food bill seems to have developed electoral connotations as well, especially in the aftermath of Sen's comments regarding Modi. While Modi has been projected as the harbinger of economic growth, Rahul contend's to be the voice of India's downtrodden. It is important we realise the need of the hour, the levels of malnutrition and starvation in the country. While the Food Security bill needs active debate and discussion, it is important the parties keep the 2014 elections out of their minds and the needs of millions below poverty line in. Like in the United States, the internet first boomed followed by online criminals and hackers. This is always been the case. Similarly, in india where internet literacy is rapidly growing along with the country''s economy its inevitable that someone abuses the luxury of literacy and misuses the internet for immoral acts. Kapil Sibal and the government have released the cyber security policy which I feel will definitely reduce the number of online crimes but technology is growing faster than we are so there will always be new ways to break into the 'system'. Despite all our efforts, despite all the laws and regulations we blindly depend on a system that fails to provide justice to thousands of people. Think about how many rapists, serial murderers, corrupt politicians roam free in our country without the modest sign of guilt or fear. This mentality of getting away with it is what makes india one of the most unsafe places to stay. The government needs to put an end to this by banning acid for household use altogether along with the 3 lakh compensation . Nearly 3 victims every week succumb to their injuries due to acid attacks. "Having a foreign carrier such as AirAsia come in, is a good sign. However such measures like the ordinance suggest that all that party politics has comes down to is bagging the most number of votes. Without any discussion the Bill will remain a paper tiger. It won't be able to rectify many of its flaws and at the end of the day become just a rallying slogan for electoral victory, a la "Garibi Hatao". Poverty and starvation will only go after concrete and workable measures are taken by taking into account the bigger picture. The passing through of the Ordinance will make a hero out of the Congress and opposition by not extending its support will emerge to be anti-poor and a villain. Prerna Trehan | Tackling Corruption In India | 201 3-07 -03 1 0:29:5 8 | The CBI's first charge sheet is out and the encounter has been termed as being staged wherein 19 years old Ishrat along with three others were abducted and then killed in a fake encounter and termed to be Lashkar members. Along with Gujarat state polce, IB official stoo have been named who were involved in this murder and criminal conspiracy. Such an incident is appalling and shakes the very foundations of a free, democratic country where civil authorities played with lives of 4 citizens and further pushed their families into a life of despair and agony. The CBI's work though commendable again is an example of delayed justice that needed repeated reprimanding and orders from the judiciary to put the work in order. It is important that a thorough investigation is carried out so as to further identify state officials and others who were involved in this brutal act. • 4. Political Parties under RTI Act Prerna Trehan | Tackling Corruption In India | 201 3-07 -02 1 0:20:37 | The Government thinks of moving an ordinance to keep Political Parties out of the RTI Act. Such a move will only lead to a violation of all that RTI stands for that is encouraging transparency and accountability. If the Parties are so confident of their character and patriotic fervour for the country they should be more than willing to disclose information regarding certain activities and funds to the masses so even we can take more informed decisions during the elections. The Association for Democratic Reforms has brought out a Joint Statement in this regard: Joint Statement regarding ordinance being passed to keep political parties out of the RTI: There are reports that the Government is thinking of promulgating an ordinance to amend the Right to Information Act. This Act was passed by our Parliament and has now become part of the extremely valuable Citizen empowerment for our democracy. We appeal to Government and all political parties to drop any consideration of amending the RTI Act. We are not aware of any emergency requiring such an Ordinance, and are confident no such move will be undertaken. 1.. Aruna Roy 2. Arvind Kejriwal 3. Prashant Bhushan 4. Anjali Bhardwaj 5. The decaying of dead bodies in Yamuna and Ganga have contaminated the water and if not brought under control could pollute the water till west Bengal. One solution I would want to advice to the people of Uttarakhand would be to follow the steps of Solar water disinfection. The process involves filling up a water bottle till the top and laying it out in the sun, preferably on top of a roof, for 4 hours. If the day is a bit cloudy then leave it there for about 8 hours. This will kill all the harmful bacteria from the water and will be safe to drink. Its been nine years and yet the CBI's investigation regarding the authenticity of the encounter remains incomplete. The Judiciary has time and again reprimanded for such lapses. Meanwhile the dainted image of CBI also gives an opportunity to BJP to claim the entire inquiry to be a hoax being conducted on the orders of the government in power. Its high time that agencies stay clear of such political games and perform the function that they are supposed and that is safeguarding the citizens of the country and ensuring the security and integrity of one and all. Ive actually been there a couple of times and each time I felt the service was crap! Maybe they've done up the place well and play decent music but that is not all what makes a restaurant worth visiting again. I dont think many of us will ever go there again and even if we do it would be to add fuel to the fire that was sparked by the firstpost blog. Its an insult to our democratic rights and anyone who turns a blind eye would be the biggest hypocrite. The incident is one thing that could have been tamed from escalating on social media but the guy had the audacity to come out in public and threaten anyone who uses social media against the restaurant. Theres one thing to threaten a bunch of kids in ur bar and another to threaten the very rights and values this country has been built on. Delhi University is supposed to set an example for many other universities in the country and by taking such impulsive and ill thought out steps, it may lead to downfall rather than improvement. There are eminent teachers and professors who are very much a part of the University family who are protesting against this change. The addition of one year also means paying extra and for economically under-privileged students this will lead to additional burden. There has already been a hiking of fees in many colleges and with hardly any hostels and lack of adequate infrastructure, many students have to take to overpriced PGs and flats. How does the University plan on accommodating such grievances. Instead of discouraging drop outs, this may lead to many students not being able to join DU due to the additional expenses and spending another year just to graduate. Also, students who want to want to pursue Masters degree in India but in universities other than DU will be wasting a year. This will at least reduce corruption and will make sure money is directly transferred to beneficiaries and not worry about corruption. However with an initiative of such magnitude needs planning and a lot of coordination with state governments. Is our government ready for it? Issuing Aadhaars to millions of people as well as opening their bank accounts and then matching the 2 is an extensive process. Jairam Ramesh and Nandan Nilekani will be addressing the National Advisory Council (NAC) as well as members of media about the plans of the government and how they will overcome various obstacles along the way. For example, the first stage, identifying the Beneficiaries through the Aadhaar Scheme. The UIDAI and NPR say 800 million aadhaars will be done in the next 15 months while 280 million have already been issued.
