Negligence involves the breach of a legal duty of care which results in injury. The elements of negligence include a duty to meet a standard of care, breach of that duty through failure to exercise reasonable care, causation between the breach and the injury, and damages. Medical professionals are considered to provide a service and can be held liable for negligence under consumer protection laws in India if their actions or lack thereof breach the duty of care owed to patients. However, the burden of proof lies with the complainant to prove negligence through a higher standard of evidence.
