Exemption transitions - ongoing
Paragraph 13 or Paragraph 21 exemption willl no longer be
able to carry out your waste operations after 5 April 2012
unless you have either:
registered for a new, free of charge waste exemption (if you
meet all the conditions and limits) or,
have made an application for an environmental permit.
Next transition date 1 October 2012 – Para’s 7, 11, 17 etc

Duty of Care
If you produce, import, keep,
transport, treat or dispose of
waste, you must:
keep it safely
handle or dispose of it by
authorised people
ensure it is accompanied
by a written description
and waste transfer note
Recent Changes - Waste Transfer Notes
From 28th September 2011 declaration on transfer note (or consignment note
for hazardous waste) that the waste management hierarchy has been
applied.
Include 2007 Standard Industrial Classification (SIC) Codes
Consultation on other forms of acceptable evidence aswell as transfer notes
Electronic Duty of Care Programme (edoc).

You must register with us (upper tier £154) if you:
transport controlled waste as a business or for profit and are
not the waste producer.
are self-employed, a partnership or company (multi-national
companies to electricians and plumbers) transporting
construction and demolition waste

Changes for Waste Carriers, Brokers and
Dealers
There are now 3 types of registrant:
carriers (those who actually move waste)
dealers (those who use an agent to buy and sell waste) and
brokers (those who arrange for the movement/disposal of waste on behalf of
others).
The term ‘Dealer’ is a new term.
From December 2013, if you normally and regularly carry your own waste in
the course of any business or for profit, you must register as a lower tier
carrier

Hazardous Waste Regulations
Hazardous waste - harmful to
human health or the environment
e.g. asbestos, fluorescent light
tubes, cathode ray tubes, oils,
solvents, batteries, chemicals.

Consignment note system
If you Produce Hazardous waste
The regulations introduce a new hazardous property H13
(sensitising) and the old 13 has now become H15 (waste
capable by any means after disposal of yielding another
substance, eg leachate, which possesses any of the H1 to H14
hazardous properties).
Anyone who produces, handles or manages hazardous waste
must take all reasonable measures to apply the waste hierarchy
when they transfer waste.
A new consignment note is available and you will need to sign a
declaration on the note to say that you have made these
considerations. You can chose to use the new consignment
notes immediately but they do not have to be used until 28
September 2011.

Separate Waste Collections
The regulations also require the separate
collection of waste paper, metal, plastic and
glass from 1 January 2015
Any person who collects any of four waste
streams – paper, metal, plastic or glass – must,
from 1 January 2015, take practical measures to
ensure separate collection of these wastes.
Before 2015, it would be advisable for waste
producers to consider any measures they might
need to take to ensure that their wastes can be
collected separately.
