The parliamentary elections in 2016 indicated that one of the most problematic issues was related to determination of which party was entitled to the supplemental funding of GEL 300,000 for creating a parliamentary faction. Due to lack of clarity, the CEC provided wrong interpretation of applicable regulations and as a result, Industry Will Save Georgia received GEL 300,000 while it failed to pass the electoral threshold of 3%, received only 0.78% of votes and was able to secure only a single majoritarian seat in parliament.1 In addition, even if such ambiguity didn’t exist we believe that the principle of providing funding to a party for creating a faction is inherently wrong. Creating a parliamentary faction should not be viewed as an additional accomplishment of a party, as this is automatically related to the party’s entry into Parliament and therefore, a party should not be receiving an additional funding for creating a faction. The funding has nothing to do with compensation of faction expenses as these expenses are already covered by the parliamentary budget.

This report provides an insight into the 2016 legislative elections in Vietnam, with an analysis of the political system and electoral process and how they are used to restrict the citizens’ right to participation. It also gives factual accounts of harassment and rights violations against the independent candidates who, for the first time in the country’s history, courageously speak out against the repressive system by employing social media and standing for an election in which they see no chance to win. Restriction of freedoms of movement, expression and assembly, intimidation and harassment by the police, defamation by the propagandists and the biased media are some among many forms of rights violation. Besides, the independent candidates are subjected to public haranguing in “meetings with constituents” which appear to be a procedure unique to China and Vietnam. The analysis and accounts highlight the conclusion that the legislative elections in Vietnam are not free and fair under the rule of the Vietnamese Communist Party. Steps should be taken to bring about a legal and political reform in the country to ensure promote human rights, of which the rights to participation are crucial.

The financial viability of the civil society sector improved slightly due to growth in crowdfunding; funding through the 2 percent Law; and the development of social entrepreneurship. Sectoral infrastructure strengthened with increased sub-granting and the growth of intersectoral partnerships. At the same time, the public image of Civil Society Organisations (CSO) worsened slightly as government propaganda continued to be used to attack them. These are some of the conclusions of the CSO Sustainability Index for 2018, an annual analytical instrument that evaluates the strength and sustainability of the CSO sector in 71 countries from Asia, Eastern and Central Europe, Eurasia, Sub-Saharan Africa, Middle East and North Africa.

The VCP’s monopoly on power can hardly be challenged, but that is actually what democracy supporters inside and outside Vietnam must do to protect and promote human rights in the country. In particular, it is strongly recommended that: 1.The system of “negotiations” be abolished; 2.A party-list system be built with the presence of more than one political party in the country; 3.The Vietnam Fatherland Front and its affiliates be disbanded, or they must stop organizing the legislative elections under the instructions of the VCP; 4.Freedom of the media be guaranteed so that the media can publish information about each candidate to provide the basis for voters’ choices, and independently observe and monitor the electoral process; 5.Freedom of expression and assembly be guaranteed so that the voters, the press and the candidates can express their support or opposition; 6.Equal treatment of all candidates be secured.

The Report provides information for the offenders’ management model in general, the cooperation between the key players in the process of managing the offenders, on the current level of coopera-tion among the Departments of the Ministry of Justice involved in the offenders’ management on key offender management issues. It combines the results from the desk study of national and inter-national legal acts and the responses of the interviewed officials from public institutions playing role in the management of offenders. The Report provides recommendations for further development of the management process. Some of them are of general nature, while others reflect particular key issues mentioned by the respondents. The recommendations are in three groups: in regard offenders’ management model, in regard the cooperation between the different players having any responsibilities in offenders’ management and in regard offenders’ management process.

Each Congressional term consists of two sessions, one during each year of a term. Bicameralism Congress consists of two houses, the House of Representatives and the Senate, that act to check and balance each other. Congress has its roots in British and Colonial history. Our bicameral legislature is a reflection of federalism, and was part of the Connecticut Compromise of 1787. House of Representatives Term: 2 years No term limits Qualifications 25 years old 7 years as a U.S. citizen Resident of represented state Reapportionment Process of re-dividing the 435 seats of the U.S. House of Representatives based upon each state's proportion of the national population. The preceding census is the baseline for determining how many House seats are allotted to each state. The measures adopted by the Chamber of Deputies on November 29, 2016 that disfigured the Anti-Corruption project of law dramatically increase the disbelief of the Brazilian population in relation to politicians and political institutions in Brazil, which is a great mark of our time. This disbelief may pave the way for the breaking of the ill-fated democratic process in Brazil with the introduction of an exception regime in the midst of growing popular dissatisfaction. Popular dissatisfaction with politicians results from the fact that most candidates for elected office in Brazil are not driven by the public interest, that is, to promote political, economic, and social changes for the benefit of the population. The Legislative Branch Article I Congress Terms and Sessions of Congress A term is the length of time between elections in Congress (two years). Each Congressional term consists of two sessions, one during each year of a term. Bicameralism Congress consists of two houses, the House of Representatives and the Senate, that act to check and balance each other. Congress has its roots in British and Colonial history. Our bicameral legislature is a reflection of federalism, and was part of the Connecticut Compromise of 1787. House of Representatives Term: 2 years No term limits Qualifications 25 years old 7 years as a U.S. citizen Resident of represented state Reapportionment Process of re-dividing the 435 seats of the U.S. House of Representatives based upon each state's proportion of the national population. The preceding census is the baseline for determining how many House seats are allotted to each state. (CO: 7) Minimum representation per state: 1 seat Wesberry vs. Sanders 1964 “One person, One vote” rule: each vote in a congressional district should be worth about the same Today each district has around 710,000 people Seats added or lost in Congressional reapportionment after 2010 census Redistricting process of redrawing legislative district boundaries every 10 years based upon changes in population. State legislatures determine district boundaries. Drawing boundaries of legislative districts to benefit one party or group and handicap another is called “gerrymandering.” Gerrymandering Gerrymandering seeks to draw legislative districts that isolate members of a particular political party so that a maximum number of representatives of that party will be elected. Gerrymandering Cont. Packing- drawing lines so they include as many of the opposing party’s voters as possible Cracking- dividing an opponent’s voters into other districts, weakens opponents voter base 2010 Kentucky Congressional Districts House of Representatives Emphasizes fiscal policy (government expenditures, revenues, and debt.) Special Powers of House of Rep. All money (appropriations) bills start here Select the President if no majority in Electoral College Write the articles of impeachment against high ranking officials Speaker of the House Head of House of Representatives -Presides over the full House. -Decides on which committees each member of his/her party will serve. -Assigns bills to committees -Decides the order in which bills will be heard and time limits for debate on House Floor. Senate Term of office: 6 years No term limits Qualifications: 30 years old 9 years a citizen of the U.S. Resident of the represented state Senate Number of Senators: 100 Representation equal (2 per State) Filibuster (unlimited debate) unless cloture is invoked. The measures adopted by the Chamber of Deputies on November 29, 2016 that disfigured the Anti-Corruption project of law dramatically increase the disbelief of the Brazilian population in relation to politicians and political institutions in Brazil, which is a great mark of our time. This disbelief may pave the way for the breaking of the ill-fated democratic process in Brazil with the introduction of an exception regime in the midst of growing popular dissatisfaction. Popular dissatisfaction with politicians results from the fact that most candidates for elected office in Brazil are not driven by the public interest, that is, to promote political, economic, and social changes for the benefit of the population. This is evidenced in the acts of the Brazilian National Congress and members of the Executive Power self-protecting from “Lava Jato Operation” which investigates corruption crimes and the government Michel Temer and his allies in the Brazilian National Congress by approving measures such as PEC 241 / PEC 55 that threaten the interests of the Brazilian population.
