Why do we need a Contract
 In most case this is as simple as evidence
that one party makes an offer and the
other accepts
 The contract will further act as a written
explanation of the detailed responsibilities
of both parties participating in the project
 This will leave little to interpretation and
should minimise most disputes from ever
occurring

Ausgrid’s franchise area’s has
been divided into four regions
as follows

 The lower Hunter – Central coast
 The upper hunter
Compliance with statutory and other
requirements of the principal contractor under
the new Deed AG4895/12
Part A - Ref A2.1
 The Contractor must comply at all times with all
legislative requirements. The Contractor must
comply at all times with the requirements of
model codes of practice, Australian Standards,
Ausgrid's standards, Ausgrid policies, technical
standards and all supplied drawings.
 Any fines or penalties levied on Ausgrid as a
result of the works under Contract will be
charged to the Contractor. Ausgrid reserves the
right to deduct such monies from payments to
the Contractor or from security monies.
 The Contractor is engaged as the Principal
Contractor in accordance with the Part B General
Conditions of Contract, clause 14.6.
Working hours under
the new Deed AG4895/12
 Working hours between the hours of 7 am and 6 pm Monday to Friday,
8 am and 1 pm Saturday.
The Contractor's working hours on major roads and in heavy pedestrian
traffic areas, such as highways, main roads and shopping centres may
be adjusted to comply with conditions imposed by traffic restriction
signs, any special restrictions imposed by the local authority and the
availability of access.
 Work outside of 7 am to 6 pm Monday to Fridays, 8 am to 1 pm
Saturday and on Sundays or public holidays may be allowed with the
approval of the Superintendent’s Representative and relevant
authorities. Such approvals must be obtained prior to the
commencement of any works.
 Outside normal working hours rates will only be applied in accordance
with clause A2.8.

Application of the schedule of rates
regarding to the working hours under
the new Deed AG4895/12
 the Superintendent’s Representative directs the Contractor in
writing that the Contractor is to perform part of the works, or part
thereof, outside of normal working hours outlined in clause A2.7
 Where there are no alternative rates (outside normal working
hours), standard rates will apply at all times (e.g. joint bay
maintenance).
 Alternative rates will only apply between the hours of 6.00 pm and
7.00 am Monday to Friday, outside of 8 am to 1 pm on Saturdays
and all day on Sundays and public holidays in New South Wales. The
Contractor will be responsible for any costs associated with stand
down in the next shift from the use of outside of normal hours rates.

The removal and disposal of waste materials
with the new Deed AG4895/12
 Waste tracking documentation covering the
disposal of all hazardous, semi-hazardous or
environmentally toxic materials must be
provided to the Superintendent’s
Representative after the materials have been
disposed of
 In addition, proof of the environmental
acceptability of the disposal method must also
be provided to Ausgrid.
 The recycling or disposal of excavated
materials must be in accordance with clause

Traffic control resource
requirements under
the new Deed AG4895/12
The Contractor is also responsible for the provision of:
 the required personnel resources in accordance with the TCP
 all necessary vehicles, signage and equipment to enable appropriate
traffic control.
 Intermittent requirements for stop/slow traffic controllers for deliveries
are required to be resourced from the contract cable laying crew.
 Contractors are also responsible for obtaining all required traffic control
permits and/or licences from the appropriate authority, for example RMS
or local councils.

Third – party standby person requirement
under the new Deed AG4895/12

 Ausgrid will meet all costs associated with
the attendance of a third-party standby
person from different Authorities or
Utilities (for example, Transgrid, Jemena,
Savcor) for the protection of their assets.
 Ausgrid will reimburse the fees only and
will not pay any additional Contractor
costs.
Classification of Surface Materials
under the new Deed AG4895/12
 Surface material requiring mechanical surface breakers (A5.1.1)
which is defined as the saw cut depth of the surface material, whether
concrete based products, asphalt or bituminous products excludes hard
core base, sub-grade or blue metal road base etc.

Requirements included in the new AG.4895/12 Deed
The treatment and disposal of slurry formed by saw cutting operations
must not contaminate or have the potential to contaminate waterways
As a minimum, wet vacuums must be used to prevent slurry entering water
ways.

Surface material is defined into three different categories:
Classification of Surface Materials

Part A - A5.1.2 Surface material special
 which may include but not be limited to, heritage listed items, decorative
paving tiles or blocks, special tiles, cobble stones, brick or wood blocks. The
contractor if unsure of the classification to seek advice from Ausgrid and the
local Authority
Requirements included in the new AG.4895/12 Deed
 The Contractor must gain approval from the relevant authority/stakeholders
to cut special surface material as detailed in this clause.
 If the contractor cuts special surface material without written approval, the
Superintendent’s Representative may direct the special material be
reinstated at the Contractor’s cost.
 An official delivery receipt must be obtained when special surface materials
are delivered to Council Depot stores & A copy of the receipt must be
provided to the Superintendent’s Representative with the submission of the
monthly Claim for Payment.
Classification of Surface Materials

Part A - A5.1.3 Surface material other
 Where the excavation of surface materials (not including special
surface materials) does not require the use of saw cutting and
mechanical surface breakers, the excavation must be carried out in
accordance with clause A5.2 – Excavation/Removal of sub-surface
materials.
 In some instances the surface turf must be removed in 75 mm thick
sections and carefully stacked to one side of the excavation in
accordance with clause A12.3.1.
 In all other instances, surface turf, soil and the like will be classed
as sub-surface material, excavated and disposed of in accordance
with clause A5.2
Excavation of roadways & driveways crossings

 During the excavation of roadways
the cover must be maintained until
the conduit has crossed the back of
the kerb at which point, cover may be
reduced to footway cover.

Excavation of joint holes & / or bays under the
new Deed AG4895/12
 Sand requirements
1. the placement of 0.5 m3 of sand bedding
material per 6 m3 or part thereof of joint bay
excavation for the convenience of the jointer in
a safe and environmentally acceptable location
immediately adjacent to the joint hole
2. This sand may be bulk supplied or
alternatively the Superintendent’s
Representative may request a supply of 30
sand bags per 6 m3 or part thereof of joint bay
 The disposal of surplus materials is claimed
under item 10 of the schedule of rates
 Generally Jointbay size will be 5m x 1.5 x 1m

Part A - A5.4 Excavation of joint holes and / or bays
Shoring requirement under the
new Deed AG4895/12
Part A - Ref A5.7 Shoring
 All shoring must strictly comply with the Code
of Practices for Excavation.
 Additionally all shoring designs must be
certified by a suitably qualified engineer with
appropriate Professional Indemnity insurance.
 For shoring in joint bays, the shoring scheme
must allow for cables to be joined without
compromising the integrity of the shoring.
 Therefore designs must consider the location
of struts and props to allow for good and safe
access for jointing.

Recycling and or disposal of surplus excavated
material under the new Deed AG4895/12
 The Contractor is responsible for the classification
of surplus excavated material. Every effort should
be made to prevent cross contamination of VENM
(Virgin Excavated Natural Material) / ENM
(Excavated Natural Material) to ensure it can be
recycled and re-used.
 Excavated material that meets recycler’s licensing
conditions should also be recycled through
appropriately licensed spoil recyclers.
 Where excavated material does not meet VEMN,
EMN or spoil recyclers licensing criteria it will be
deemed only suitable for landfill and must be
taken to a landfill facility licensed to accept
General Solid Waste.

 This will also include General Solid Waste that contains Special
Waste (asbestos).
 Any excavated materials that are classified as restricted solid or
hazardous waste (may also contain special waste) must be waste
tracked prior to transporting to an appropriately licensed waste
facility by: obtaining a ‘consignment approval’ from the receiving
facility and completing a waste transport certificate.
 The Superintendent’s Representative must be notified and
provided with the completed waste tracking documentation within
48 hours of the restricted or hazardous waste being disposed of.

 Acid Sulphate Soils (ASS) should be managed and
re-used onsite in accordance with the NSW Acid
Sulphate Soils manual where feasible.
 Where this is not feasible, ASS will need to be
managed in accordance with the Waste
Classification Guidelines, Part 4: Acid Sulphate
Soils
(http://www.environment.nsw.gov.au/resources/
waste/08446acidsulfsoils.pdf).
 Once treated on site and classified, the treated
waste must be taken to the appropriate waste
facility.
Trenchless Technology additional requirements
under the new Deed AG4895/12
 All Trenchless requirements are provided in
Ausgrid’s network standards and all Trenchless
boring activities must be completed in accordance
with NS 130 and referenced standards and any
new network standard implemented during the
course of the Contract.
 The Contractor may be required to use three
different Trenchless technology techniques as
specified in the Contract which include:
Horizontal boring
Case boring
directional boring
 The Contractor may also be required to provide a
quote for Micro-tunnelling under railways as it is
the preferred method of boring by State Rail.

Horizontal boring additional requirements
under the new Deed AG4895/12
A6.1 Horizontal boring
 NS 130 specifies a minimum cover of
1.0 metre.
 Where the cover is less than 1.0 metres
the Contractor must seek written
approval from the Superintendent’s
Representative.
 Horizontal bore rate includes the Supply
and installation of 1 x 50 mm internal
diameter conduit.

Construction of block work jointing pits additional
requirements under the new Deed AG4895/12
A7.3 Construction of block work jointing pits
 The Contractor may be required to construct block work pits
in accordance with Ausgrid’s drawing no. 152597 or 125598,
this Specification and Ausgrid’s Network Standard 172 –
Design requirements for cable jointing pits and vaults.
 The Contractor will be required to notify the Superintendent’s
Representative during the following points of construction for
inspection prior to the commencement of the next stage:

Core drilling additional requirements under

A7.4 Core drilling
 On completion of the core drilling,
the Contractor must seal between the
installed conduits and the core hole
to prevent the ingress of water and
excavated material.
 A bell-mouth is to be installed for
each full penetration and the interior
of the pit grouted if required and
cleaned of any debris coming from
the Contractor’s works.

Installation of draw lines additional
requirements under the new Deed AG4895/12
A8.4 Installation of draw lines
The Superintendent’s Representative may direct the
installation of draw lines into spare conduits. The draw lines
must meet the requirements of Telstra / Parramatta rope.
 Telstra / Parramatta rope is (blue–yellow) 6 mm, three
strand poly–rope with a tensile strength of 610 kilograms.
 The end of the draw line should be secured (taped) to the
inside of the conduit to allow the standard process for the
fitting of end caps.
Thermally stable bedding materials additional

A9.1.1 Thermally stable bedding
materials
 Compaction of material overlying
TSB is not permitted until overnight
cure of TSB has occurred.
Installation must be strictly in
accordance with NS 130.

127, NS 130 (and other relevant Ausgrid

termination pillar bases.
 The installation of pillar boxes must ensure
that the pillar boxes lay true, perpendicular
to adjacent property lines and installed to a
depth nominated in accordance with NS127.

Installing underground cables to overhead
poles requirements under the new Deed
AG4895/12
 If Ausgrid’s overhead personnel are not able
to attend, the Contractor must delay the
work until they are available or bury the
cables adjacent to the pole as directed by
the Superintendent’s Representative or
install and secure the cable in a suitable
UGOH protection box.
 Flexible conduit should extend 1000 mm
from the base of the pole and 800 mm
above ground level.

Installing underground cables into overhead transition points
Cable pulling and handling equipment requirements under
the new Deed AG4895/12
 The rates for cable installation include all plant & equipment
required for the handling and installation of cable that is supplied
on standard cable drums.
 In addition, the Contractor is required to have cable drum stands
capable of handling non-standard cable drums of up to ten tonnes
in mass.
 The Contractor must have the capacity to load, unload and
manoeuvre non-standard cable drums.
 Where non-standard cable drums are used, the Contractor is
responsible for the coordination of cable drum transport.

 Ausgrid is responsible for delivering the cable drums to site where
Contractors are responsible for unloading the drums, manoeuvring
the drums and loading the used/empty drums on to the Ausgrid
supplied transport.
 The Contractor will responsible for the security of the drums and
safe storage of the drums until collected by the Ausgrid supplied
transport.

Recovery of cables additional requirements

A11.3 Recovery of cable (Continued)
 The Superintendent’s Representative may issue an instruction to cut
the recovered cable into one metre lengths and place the cable into
bins located at Ausgrid depots or to cut and store the cable lengths
for Ausgrid to collect prior to practical completion as part of the
materials listed on the Cable and Materials Return Sheet (see clause
A13.22).
 In cases where Superintendent’s Representative requests a cable
return, the Contractor is responsible for the security of the cable
until Ausgrid receives the cable from the Contractor.
 See clause A13.22 for more information regarding the return of
scrap cable.
 The Contractor must record the details of the amount and types of
cables recovered and recovery locations. The Contractor must also
record details of the disposal method of all recovered cables and
provide details as part of the Monthly Report (form no. DC0003).

Backfill of jointbay excavations additional

A12.1.1 Backfill of jointbay excavations
 The backfilling of joint bays must be
carried out in accordance with clause
A12.1.
 The Superintendent’s Representative
will provide the Contractor at least 24
hours notice for backfilling of joint
bays.

Temporary reinstatement of excavations
requirements under the new Deed AG4895/12
A12.2 temporary restatement of excavations
 Temporary reinstatement also includes for the reinstatement of all
disturbed signs and temporary line marking, in particular, traffic
control and safety line marking. Line marking for traffic control and
safety must be restore within 72 hours of temporary reinstatement.
 Temporary reinstatement must be installed at a suitable temperature
with no more than 10 mm deviation from true when a 2 m straight
edge is laid in any direction. For roads and footpaths the crown must
not be greater than 10 mm on either side when a 2 m straight edge is
laid perpendicular to the longitudinal axis of the excavation and
parallel to adjacent undisturbed surfaces.
 All state and regional roads are to be rolled to achieve the desired
compaction and surface finish. Edges of the temporary reinstatement
and adjacent surfaces must meet and the temporary reinstatement
edge must not be greater than +10 mm and -0 mm from the adjacent
edge.

In addition, the Contractor must maintain contract
specific quality, work health and safety (WHS)
and environmental management plans for the
entire contract term.
 The Contractor must promptly update the
management plans from time to time to take
account changes to relevant legislative
requirements and promptly submit the updated
management plans to Ausgrid.

A13.5 Environment
 All work must be carried out in an environmentally acceptable and
responsible manner, and in accordance with NUS 174 ‘Environmental
Procedures’.
In carrying out the works, the Contractor must:
1. Minimise the generation of waste
2. Separate generated waste for re-use or recycling

Induction of contract personnel requirements

A13.13 Induction of Contract personnel
temporary restatement of excavations
 When the Contractor takes control of the site
as the Principal Contractor it will be the
responsibility of the Contractor to induct
their personnel as per the requirements of
the Contractor’s WHSMP for the site.
 Any Ausgrid staff required to enter the site
must be inducted as per the requirements of
the Contractor’s WHSMP.
 Any people who refuse to be inducted to the
site must be removed and work must be
stopped until they are removed.
 In the case of Ausgrid personnel refusing an
induction, the Superintendent’s
Representative must be contacted to
intervene.
Competence, training and qualifications of
contract personnel requirements under the

 Substation entry training is
required for all Contract personnel

delivery per supplier per order.
 Any extra orders will be charged

will be a debt due and

Contractor to Ausgrid.

A13.17 Ordering Ausgrid materials
Ausgrid cable drums requirements under the
new Deed AG4895/12
 Ausgrid will deduct a deposit of $1,500 for
each issued cable drum from the following
Payment Claim —as a deposit to be
returned—upon the safe return of each
cable drum issued to Contractors under
the Contract(s).
 Ausgrid will deduct the $1,500 for each
drum regardless of the drum size.
 Deposits will not be deducted if cable
drums are issued and then returned to
Ausgrid before the monthly Payment Claim
is received.
 Deposits will be returned to Contractors as
part of the Payment Claim immediately
following the return of cable drums.

Care for other Ausgrid supplied

A13.23 Care for other Ausgrid supplied materials
 The Contractor will be responsible for adequately securing all Ausgrid
materials on site.
 Any costs incurred by Ausgrid for both labour and materials as a result of
a Contractor’s failure to provide adequate security for materials under the
Contractor’s control, will be payable to Ausgrid by the Contractor.
 The Contractor will be responsible for all materials until which time
practical completion is issued or cables are energised and become part of
Ausgrid’s network.
 A statutory declaration for lost, missing or stolen Ausgrid material must
be supplied with a detailed description of the reasons and cause of the
event.

Notification to affected stakeholders
requirements under the new Deed AG4895/12
A13.26 Notification to affected stakeholders
 The Contractor must, at no cost to Ausgrid, deliver to any stakeholder,
entity or individual who may be affected by the works, a letter approved
by Ausgrid describing the proposed work along the routes in the Contract
and the dates it will commence and be completed.
 The letter must be in accordance with Ausgrid’s standard letter templates
and the Contract Cable Laying Customer Communication Guidelines
 Except in the case of urgent work, such letters must be delivered not less
than forty-eight hours prior to the commencement of any excavation
work during normal working hours.
 For works outside standard working hours, notifications must be delivered
in accordance with the direction given under the Ausgrid Contract Cable
Laying Communications Plan and the Superintendent’s Representative.
 For urgent work the Contractor must, as soon as possible, deliver to any
third party, entity or individual who may be affected by the works, a letter
approved by Ausgrid and in accordance with the Contract Cable Laying
Customer Communication Guidelines, explaining the need for the work to
be carried out at short notice.
Services and materials provided
by Ausgrid requirements under
the new Deed AG4895/12
 The plans, drawings and other documents accompanying this Part A
Specification are listed in the annexure of the Part B General Conditions of
Contract.
 Unless as a requirement of this Contract, the Contractor must not alter,
amend, add to or omit any item explained by documents issued under the
Contract, without the written approval of the Superintendent’s
Representative.
 Ausgrid will provide one copy of the forms and documents prior to the
commencement of the contract. It will then be the Contractor’s
responsibility to print additional copies as required.
 All documents used on this Contract will be provided by the Contractor,
using master documents approved and reviewed by the Superintendent’s
Representative and amended by the Superintendent’s Representative as
required.
A14.1 Documents
Ausgrid induction requirements
under the new Deed AG4895/12
 All Contract personnel are required to complete an Ausgrid induction
before they can work on Ausgrid contracts.
 The minimum entry level of training required to receive an induction
is the
1. general construction induction training
2. Ausgrid Electrical Safety Rules and environmental
3. CPR
4. perform rescue procedures from a live LV panel
5. first aid in the ESI environment training modules.
These modules must be completed prior to requesting inductions for
contract personnel.

 Induction will be assessment only. Inductees will undertake a
competency based assessment and have two opportunities to pass
the assessment.
 If the inductee is unsuccessful, they will be required to repeat the
web based induction at another time and then repeat the induction
assessment on another occasion.
 If competence is achieved, an induction sticker is printed and
placed in the relevant ESI Skills Passport (see clause A14.4) and an
Ausgrid induction card is issued.
Ausgrid induction requirements

 The Contractor must request a password to access web
based induction training for each person to be inducted by
emailing <contractorsafety@ausgrid.com.au>.
 The inductee will be required to log in to the web based
induction training, upload a photo and complete training
information and dates. The inductee will be required to
complete the learning modules in their own time.
 Once the contract personnel have completed the web based
induction training, the Contractor must request an induction
assessment by emailing
<contractorsafety@ausgrid.com.au>. The request must be
entered prior to Thursday at 9:00 am for any given week.
Induction assessments will run on Tuesday of each week or
as required.

 Contract personnel attending induction assessments must
have original certified evidence of the completion of all
minimum training requirements including their WorkCover
general construction induction training and 100 points of
identification (a driver’s licence and credit card is
sufficient).
 Failure to produce this evidence at the induction will
result in the contract personnel being excluded from the
session.

A14.8.1 Recording contractor performance
 The performance of the Contractor and Contractor personnel will be
documented in a worksite inspection report by a Contract Inspector,
Superintendent, Superintendent’s Representative or Safety Advisor after
a performance observation is completed.
 Non-conformance may be issued for the Contractor’s failure to provide
notices, notifications, forms and reports in accordance with the Contract
requirements.
 The Contractor may be required to pay the charge out rate if the
Superintendent’s Representative issues a non-conformance notice due to
poor performance in additional to other remedies available under the
Part B General Conditions of Contract.

Contractor’s Construction Program

Part A - A33.2 Construction Program
 The Contractor shall on or before the Date of Contract prepare and lodge
with the Superintendent a construction program for the approval of the
Superintendent showing the Contractor's bona fide planned work activities
& sequences for bringing the work under the Contract to Practical
Completion by the Date for Practical Completion and which complies with
the other requirements of the Contract.
 If the Superintendent rejects a construction program or revised
construction program submitted by the Contractor under this clause, the
Contractor shall promptly amend the construction program & resubmit it
to the Superintendent for approval.
 No changes shall be made to any construction program approved by the
Superintendent without the prior written approval of the Superintendent.

Ausgrid regarding early practical completion
under the new Deed AG4895/12
(General conditions of contract)
 The Principal, the Superintendent and the Principal's employees,
consultants, other contractors and agents will not be obliged to do or
refrain from doing anything to enable the Contractor to reach Practical
Completion before the Date for Practical Completion, and doing or
refraining from doing anything to enable the Contractor to reach
Practical Completion before the Date for Practical Completion is not a
breach, act or omission by any of them.
 The time for performance of the Principal's or the Superintendent's
obligations shall not be affected by the Contractor's desire or attempts
to reach Practical Completion before the Date for Practical Completion.

33.3 - Principal & superintendent not obliged to help
finish early
The Contractor falling behind
the Construction Program under
the new Deed AG4895/12 –

 If at any time the progress of the work under the Contract has
fallen behind that shown in the latest construction program
approved by the Superintendent or otherwise is not in accordance
with the Contract, the Contractor shall at its own cost take the
necessary corrective action so as to ensure that progress is
maintained in accordance with the Contract.
 Subject to Clause 32, such corrective action may include the
working of overtime and additional shifts, the application of more
resources to carry out the work and the adjustment and
rescheduling of activities.

may direct the Contractor to provide

  • 2. Training Objectives  To raise awareness of the Ausgrid Standing Order Deed  To Highlight Changes in the new Ausgrid Standing Order Deed Document No. AG.4895/12
  • 3. Why do we need a Contract  In most case this is as simple as evidence that one party makes an offer and the other accepts  The contract will further act as a written explanation of the detailed responsibilities of both parties participating in the project  This will leave little to interpretation and should minimise most disputes from ever occurring  Both sides must understand and sign the document to execute the contract

Site inspection To be completed prior to the basis of offer (stage 2) The contractor & Ausgrid’s representative will examine the proposed works including but not limiting to reviewing  The condition of existing properties including heritage items and the area immediately surrounding the work.   • 11. Proposed works Order Agreed Amendments - stage 4 If the Contractor does not propose amendments to the proposed works order stage 4 will not apply and Ausgrid representative will complete and deliver stage 5 to the Contractor
  • 12. Works Order Acceptance by Ausgrid – stage 5  The Contractor offer will remain open for acceptance for six months after it is delivered to Ausgrid  Ausgrid is not obliged to accept the contractor offer, even if the contractor proposes no amendments to the basis offer issued by Ausgrid  Ausgrid rejection of the contractors offer must be in writing. Ausgrid may engage another contractor to undertake the proposed works
  • 13. Changes to the regions under the new Deed AG4895/12 Ausgrid’s franchise area’s has been divided into four regions as follows  North Sydney and Sydney CBD  The Sydney Metropolitan  The lower Hunter – Central coast  The upper hunter
  • 14. Compliance with statutory and other requirements of the principal contractor under the new Deed AG4895/12 Part A - Ref A2.1  The Contractor must comply at all times with all legislative requirements. The Contractor must comply at all times with the requirements of model codes of practice, Australian Standards, Ausgrid's standards, Ausgrid policies, technical standards and all supplied drawings.  Any fines or penalties levied on Ausgrid as a result of the works under Contract will be charged to the Contractor. Ausgrid reserves the right to deduct such monies from payments to the Contractor or from security monies.  The Contractor is engaged as the Principal Contractor in accordance with the Part B General Conditions of Contract, clause 14.6.
  • 15. Working hours under the new Deed AG4895/12  Working hours between the hours of 7 am and 6 pm Monday to Friday, 8 am and 1 pm Saturday. The Contractor's working hours on major roads and in heavy pedestrian traffic areas, such as highways, main roads and shopping centres may be adjusted to comply with conditions imposed by traffic restriction signs, any special restrictions imposed by the local authority and the availability of access.  Work outside of 7 am to 6 pm Monday to Fridays, 8 am to 1 pm Saturday and on Sundays or public holidays may be allowed with the approval of the Superintendent’s Representative and relevant authorities. Such approvals must be obtained prior to the commencement of any works.  Outside normal working hours rates will only be applied in accordance with clause A2.8. Part A - Ref A2.7 Working Hours
  • 16. Application of the schedule of rates regarding to the working hours under the new Deed AG4895/12  the Superintendent’s Representative directs the Contractor in writing that the Contractor is to perform part of the works, or part thereof, outside of normal working hours outlined in clause A2.7  Where there are no alternative rates (outside normal working hours), standard rates will apply at all times (e.g. joint bay maintenance).  Alternative rates will only apply between the hours of 6.00 pm and 7.00 am Monday to Friday, outside of 8 am to 1 pm on Saturdays and all day on Sundays and public holidays in New South Wales. The Contractor will be responsible for any costs associated with stand down in the next shift from the use of outside of normal hours rates.  Please refer to the new deed for full schedule of rate details Part A - Ref A2.8 Application of the schedule of rates.
  • 17. The removal and disposal of waste materials with the new Deed AG4895/12  Waste tracking documentation covering the disposal of all hazardous, semi-hazardous or environmentally toxic materials must be provided to the Superintendent’s Representative after the materials have been disposed of  In addition, proof of the environmental acceptability of the disposal method must also be provided to Ausgrid.  The recycling or disposal of excavated materials must be in accordance with clause A5.9  Please refer to the new deed for full removal and disposal of waste details Part A - Ref A3.12 Removal of disposal of waste

On site Documentation requirement with the new Deed AG4895/12  The Contractor must ensure the following are provided, developed, documented, implemented, reviewed, revised and at all times readily available for inspection at all work sites where required under the Contract:  contract specific quality, WHS and environmental management plans  Hazard Assessment Check/s & Safe Work Method Statement/s  current version of Ausgrid’s Electrical Safety Rules & Dial Before You Dig Plans  Ausgrid design plans, Work Order including Stages and notes  site measurements taken from the pre Works Order inspection  Traffic Management Plan, traffic control plan , Pedestrian Control Plan  access & entry permits  Hazardous Substances Register & Material Safety Data Sheets for all hazardous substances used on site Part A - Ref A3.2 & A3.3 Quality, safety and environmental site Documentation

On site Documentation requirement with the new Deed AG4895/12 (continued) Part A - Ref A3.2 & A3.3 Quality, safety and environmental site Documentation  ‘Ausgrid Contractor’ ID cards & ESI Skills Passports & emergency evacuation procedures  details of the route to the nearest hospital and the nearest medical centre (these are to be kept separately from other paperwork and easily accessible)  plant/equipment checklists & RMS and Council approvals  heritage assessment(s) & Electricity Supply (Infrastructure Protection) Regulations 2009  Relevant Australia Codes of Practice from NSW Work Cover and Safe Work Australia (e.g. Excavation)  EIA or REF documentation specific to the site & NUS 174 Environmental Handbook  NS 130, other relevant network standards & Relevant Australian Standards  any documentation recording the details of the Contract requirements  all relevant permits, licences, exemptions required to carry out the work.

Traffic control resource requirements under the new Deed AG4895/12 The Contractor is also responsible for the provision of:  the required personnel resources in accordance with the TCP  all necessary vehicles, signage and equipment to enable appropriate traffic control.  Intermittent requirements for stop/slow traffic controllers for deliveries are required to be resourced from the contract cable laying crew.  Contractors are also responsible for obtaining all required traffic control permits and/or licences from the appropriate authority, for example RMS or local councils.  Please refer to the new deed for full traffic control details Part A - A3.8.1 Traffic control resources requirements
  • 21. Third – party standby person requirement under the new Deed AG4895/12 Part A - Ref A3.13 Third- party standby person  Ausgrid will meet all costs associated with the attendance of a third-party standby person from different Authorities or Utilities (for example, Transgrid, Jemena, Savcor) for the protection of their assets.  Ausgrid will reimburse the fees only and will not pay any additional Contractor costs.
  • 22. Classification of Surface Materials under the new Deed AG4895/12  Surface material requiring mechanical surface breakers (A5.1.1) which is defined as the saw cut depth of the surface material, whether concrete based products, asphalt or bituminous products excludes hard core base, sub-grade or blue metal road base etc.  surface material special (A5.1.2)  surface material other. (A5.1.3) Requirements included in the new AG.4895/12 Deed The treatment and disposal of slurry formed by saw cutting operations must not contaminate or have the potential to contaminate waterways As a minimum, wet vacuums must be used to prevent slurry entering water ways. Part A - A5.1 Surface material is defined into three different categories:

Classification of Surface Materials under the new Deed AG4895/12 Part A - A5.1.2 Surface material special  which may include but not be limited to, heritage listed items, decorative paving tiles or blocks, special tiles, cobble stones, brick or wood blocks. The contractor if unsure of the classification to seek advice from Ausgrid and the local Authority Requirements included in the new AG.4895/12 Deed  The Contractor must gain approval from the relevant authority/stakeholders to cut special surface material as detailed in this clause.  If the contractor cuts special surface material without written approval, the Superintendent’s Representative may direct the special material be reinstated at the Contractor’s cost.  An official delivery receipt must be obtained when special surface materials are delivered to Council Depot stores & A copy of the receipt must be provided to the Superintendent’s Representative with the submission of the monthly Claim for Payment.
  • 24. Classification of Surface Materials under the new Deed AG4895/12 Part A - A5.1.3 Surface material other  Where the excavation of surface materials (not including special surface materials) does not require the use of saw cutting and mechanical surface breakers, the excavation must be carried out in accordance with clause A5.2 – Excavation/Removal of sub-surface materials.  In some instances the surface turf must be removed in 75 mm thick sections and carefully stacked to one side of the excavation in accordance with clause A12.3.1.  In all other instances, surface turf, soil and the like will be classed as sub-surface material, excavated and disposed of in accordance with clause A5.2

Excavation of joint holes & / or bays under the new Deed AG4895/12  Sand requirements 1. the placement of 0.5 m3 of sand bedding material per 6 m3 or part thereof of joint bay excavation for the convenience of the jointer in a safe and environmentally acceptable location immediately adjacent to the joint hole 2. Shoring requirement under the new Deed AG4895/12 Part A - Ref A5.7 Shoring  All shoring must strictly comply with the Code of Practices for Excavation.  Additionally all shoring designs must be certified by a suitably qualified engineer with appropriate Professional Indemnity insurance.  For shoring in joint bays, the shoring scheme must allow for cables to be joined without compromising the integrity of the shoring.  Therefore designs must consider the location of struts and props to allow for good and safe access for jointing.  Please refer to the new deed for full shoring details
  • 28. Recycling and or disposal of surplus excavated material under the new Deed AG4895/12  The Contractor is responsible for the classification of surplus excavated material. Every effort should be made to prevent cross contamination of VENM (Virgin Excavated Natural Material) / ENM (Excavated Natural Material) to ensure it can be recycled and re-used.  Excavated material that meets recycler’s licensing conditions should also be recycled through appropriately licensed spoil recyclers.  Where excavated material does not meet VEMN, EMN or spoil recyclers licensing criteria it will be deemed only suitable for landfill and must be taken to a landfill facility licensed to accept General Solid Waste.   • 29. Recycling and or disposal of surplus excavated material under the new Deed AG4895/12 Ref A5.9 Recycling and /or disposal of surplus excavated material (continue)  This will also include General Solid Waste that contains Special Waste (asbestos).  Any excavated materials that are classified as restricted solid or hazardous waste (may also contain special waste) must be waste tracked prior to transporting to an appropriately licensed waste facility by: obtaining a ‘consignment approval’ from the receiving facility and completing a waste transport certificate.  The Superintendent’s Representative must be notified and provided with the completed waste tracking documentation within 48 hours of the restricted or hazardous waste being disposed of.
  • 30. Recycling and or disposal of surplus excavated material under the new Deed AG4895/12 Ref A5.9 Recycling and /or disposal of surplus excavated material (continue)  Acid Sulphate Soils (ASS) should be managed and re-used onsite in accordance with the NSW Acid Sulphate Soils manual where feasible.  Where this is not feasible, ASS will need to be managed in accordance with the Waste Classification Guidelines, Part 4: Acid Sulphate Soils (http://www.environment.nsw.gov.au/resources/ waste/08446acidsulfsoils.pdf).  Once treated on site and classified, the treated waste must be taken to the appropriate waste facility.
  • 31. Trenchless Technology additional requirements under the new Deed AG4895/12  All Trenchless requirements are provided in Ausgrid’s network standards and all Trenchless boring activities must be completed in accordance with NS 130 and referenced standards and any new network standard implemented during the course of the Contract.  The Contractor may be required to use three different Trenchless technology techniques as specified in the Contract which include: Horizontal boring Case boring directional boring  The Contractor may also be required to provide a quote for Micro-tunnelling under railways as it is the preferred method of boring by State Rail.  Please refer to the new deed for full Trenchless details A6 Trenchless Technology requirements

Horizontal boring additional requirements under the new Deed AG4895/12 A6.1 Horizontal boring  NS 130 specifies a minimum cover of 1.0 metre.  Where the cover is less than 1.0 metres the Contractor must seek written approval from the Superintendent’s Representative.  Horizontal bore rate includes the Supply and installation of 1 x 50 mm internal diameter conduit.  Please refer to the new deed for the full Horizontal boring Details

Construction of block work jointing pits additional requirements under the new Deed AG4895/12 A7.3 Construction of block work jointing pits  The Contractor may be required to construct block work pits in accordance with Ausgrid’s drawing no. 152597 or 125598, this Specification and Ausgrid’s Network Standard 172 – Design requirements for cable jointing pits and vaults.  The Contractor will be required to notify the Superintendent’s Representative during the following points of construction for inspection prior to the commencement of the next stage:  Please refer to the new deed for full jointing pit Details

Core drilling additional requirements under the new Deed AG4895/12 A7.4 Core drilling  On completion of the core drilling, the Contractor must seal between the installed conduits and the core hole to prevent the ingress of water and excavated material.  A bell-mouth is to be installed for each full penetration and the interior of the pit grouted if required and cleaned of any debris coming from the Contractor’s works.  Please refer to the new deed for full Core drilling details
  • 35. Installation of draw lines additional requirements under the new Deed AG4895/12 A8.4 Installation of draw lines The Superintendent’s Representative may direct the installation of draw lines into spare conduits. The draw lines must meet the requirements of Telstra / Parramatta rope.  Telstra / Parramatta rope is (blue–yellow) 6 mm, three strand poly–rope with a tensile strength of 610 kilograms.  The end of the draw line should be secured (taped) to the inside of the conduit to allow the standard process for the fitting of end caps.
  • 36. Thermally stable bedding materials additional requirements under the new Deed AG4895/12 A9.1.1 Thermally stable bedding materials  Compaction of material overlying TSB is not permitted until overnight cure of TSB has occurred. Installation must be strictly in accordance with NS 130.  The use of dry mix must be approved by the Superintendent’s Representative. Protection of cables additional requirements under the new Deed AG4895/12 A9.2 Protection of cables  For mechanically protected cables; concrete encased, TSB encased cables, and mild steel plate protected cables, polymeric protection is not required.  Contractors are required in this case to install electricity warning tape.  Please refer to the new deed for full cable protection details

Cable pulling and handling equipment requirements under the new Deed AG4895/12  The rates for cable installation include all plant & equipment required for the handling and installation of cable that is supplied on standard cable drums.  In addition, the Contractor is required to have cable drum stands capable of handling non-standard cable drums of up to ten tonnes in mass.  The Contractor must have the capacity to load, unload and manoeuvre non-standard cable drums.  Where non-standard cable drums are used, the Contractor is responsible for the coordination of cable drum transport. Cable pulling and handling equipment requirements under the new Deed AG4895/12  Ausgrid is responsible for delivering the cable drums to site where Contractors are responsible for unloading the drums, manoeuvring the drums and loading the used/empty drums on to the Ausgrid supplied transport.  The Contractor will responsible for the security of the drums and safe storage of the drums until collected by the Ausgrid supplied transport.  Please refer to the new deed for full Cable and handling equipment details A11.2 Cable pulling and handling equipment (Continued)
  • 45. Recovery of cables additional requirements under the new Deed AG4895/12 A11.3 Recovery of cable (Continued)  The Superintendent’s Representative may issue an instruction to cut the recovered cable into one metre lengths and place the cable into bins located at Ausgrid depots or to cut and store the cable lengths for Ausgrid to collect prior to practical completion as part of the materials listed on the Cable and Materials Return Sheet (see clause A13.22).  In cases where Superintendent’s Representative requests a cable return, the Contractor is responsible for the security of the cable until Ausgrid receives the cable from the Contractor.  See clause A13.22 for more information regarding the return of scrap cable.  The Contractor must record the details of the amount and types of cables recovered and recovery locations. The Contractor must also record details of the disposal method of all recovered cables and provide details as part of the Monthly Report (form no.   • 46. Temporary reinstatement of excavations requirements under the new Deed AG4895/12 A12.2 temporary restatement of excavations  Temporary reinstatement also includes for the reinstatement of all disturbed signs and temporary line marking, in particular, traffic control and safety line marking. Line marking for traffic control and safety must be restore within 72 hours of temporary reinstatement.  Temporary reinstatement must be installed at a suitable temperature with no more than 10 mm deviation from true when a 2 m straight edge is laid in any direction. For roads and footpaths the crown must not be greater than 10 mm on either side when a 2 m straight edge is laid perpendicular to the longitudinal axis of the excavation and parallel to adjacent undisturbed surfaces.  All state and regional roads are to be rolled to achieve the desired compaction and surface finish. Edges of the temporary reinstatement and adjacent surfaces must meet and the temporary reinstatement edge must not be greater than +10 mm and -0 mm from the adjacent edge.  Please refer to the new deed for full temporary restatement details

Induction of contract personnel requirements under the new Deed AG4895/12 A13.13 Induction of Contract personnel temporary restatement of excavations  When the Contractor takes control of the site as the Principal Contractor it will be the responsibility of the Contractor to induct their personnel as per the requirements of the Contractor’s WHSMP for the site.  Any Ausgrid staff required to enter the site must be inducted as per the requirements of the Contractor’s WHSMP.  Any people who refuse to be inducted to the site must be removed and work must be stopped until they are removed.  In the case of Ausgrid personnel refusing an induction, the Superintendent’s Representative must be contacted to intervene.

  • 58. Notification to affected stakeholders requirements under the new Deed AG4895/12 A13.26 Notification to affected stakeholders  The Contractor must, at no cost to Ausgrid, deliver to any stakeholder, entity or individual who may be affected by the works, a letter approved by Ausgrid describing the proposed work along the routes in the Contract and the dates it will commence and be completed.  The letter must be in accordance with Ausgrid’s standard letter templates and the Contract Cable Laying Customer Communication Guidelines  Except in the case of urgent work, such letters must be delivered not less than forty-eight hours prior to the commencement of any excavation work during normal working hours.  For works outside standard working hours, notifications must be delivered in accordance with the direction given under the Ausgrid Contract Cable Laying Communications Plan and the Superintendent’s Representative.  For urgent work the Contractor must, as soon as possible, deliver to any third party, entity or individual who may be affected by the works, a letter approved by Ausgrid and in accordance with the Contract Cable Laying Customer Communication Guidelines, explaining the need for the work to be carried out at short notice.
  • 59. Services and materials provided by Ausgrid requirements under the new Deed AG4895/12  The plans, drawings and other documents accompanying this Part A Specification are listed in the annexure of the Part B General Conditions of Contract.  Unless as a requirement of this Contract, the Contractor must not alter, amend, add to or omit any item explained by documents issued under the Contract, without the written approval of the Superintendent’s Representative.  Ausgrid will provide one copy of the forms and documents prior to the commencement of the contract. It will then be the Contractor’s responsibility to print additional copies as required.  All documents used on this Contract will be provided by the Contractor, using master documents approved and reviewed by the Superintendent’s Representative and amended by the Superintendent’s Representative as required. Ausgrid induction requirements under the new Deed AG4895/12  All Contract personnel are required to complete an Ausgrid induction before they can work on Ausgrid contracts.  The minimum entry level of training required to receive an induction is the 1. general construction induction training 2. Ausgrid Electrical Safety Rules and environmental 3. CPR 4. perform rescue procedures from a live LV panel 5. first aid in the ESI environment training modules. These modules must be completed prior to requesting inductions for contract personnel. Part A - A14.2 Ausgrid induction requirements
  • 61. Ausgrid recording contractors performance induction requirements under the new Deed AG4895/12 A14.2 Ausgrid induction requirements (continued)  Induction will be assessment only. Inductees will undertake a competency based assessment and have two opportunities to pass the assessment.  If the inductee is unsuccessful, they will be required to repeat the web based induction at another time and then repeat the induction assessment on another occasion.  If competence is achieved, an induction sticker is printed and placed in the relevant ESI Skills Passport (see clause A14.4) and an Ausgrid induction card is issued.
  • 62. Ausgrid induction requirements under the new Deed AG4895/12  The Contractor must request a password to access web based induction training for each person to be inducted by emailing <contractorsafety@ausgrid.com.au>.  The inductee will be required to log in to the web based induction training, upload a photo and complete training information and dates. The inductee will be required to complete the learning modules in their own time.  Once the contract personnel have completed the web based induction training, the Contractor must request an induction assessment by emailing <contractorsafety@ausgrid.com.au>. The request must be entered prior to Thursday at 9:00 am for any given week. Induction assessments will run on Tuesday of each week or as required. A14.2 Ausgrid induction requirements (continued)
  • 63. Ausgrid induction requirements under the new Deed AG4895/12 A14.2 Ausgrid induction requirements (continued)  Contract personnel attending induction assessments must have original certified evidence of the completion of all minimum training requirements including their WorkCover general construction induction training and 100 points of identification (a driver’s licence and credit card is sufficient).  Failure to produce this evidence at the induction will result in the contract personnel being excluded from the session.
  • 64. Ausgrid recording Contractor’s performance requirements under the new Deed AG4895/12 A14.8.1 Recording contractor performance  The performance of the Contractor and Contractor personnel will be documented in a worksite inspection report by a Contract Inspector, Superintendent, Superintendent’s Representative or Safety Advisor after a performance observation is completed.  Non-conformance may be issued for the Contractor’s failure to provide notices, notifications, forms and reports in accordance with the Contract requirements.  The Contractor may be required to pay the charge out rate if the Superintendent’s Representative issues a non-conformance notice due to poor performance in additional to other remedies available under the Part B General Conditions of Contract.  Please refer to the new deed for the full Recoding of contractors performance details
  • 65. Contractor’s Construction Program under the new Deed AG4895/12 – (General conditions of contract) Part A - A33.2 Construction Program  The Contractor shall on or before the Date of Contract prepare and lodge with the Superintendent a construction program for the approval of the Superintendent showing the Contractor's bona fide planned work activities & sequences for bringing the work under the Contract to Practical Completion by the Date for Practical Completion and which complies with the other requirements of the Contract.  If the Superintendent rejects a construction program or revised construction program submitted by the Contractor under this clause, the Contractor shall promptly amend the construction program & resubmit it to the Superintendent for approval.  No changes shall be made to any construction program approved by the Superintendent without the prior written approval of the Superintendent.  Please refer to the new deed ( General conditions of contract) for the full Construction Program details
  • 66. Ausgrid regarding early practical completion under the new Deed AG4895/12 (General conditions of contract)  The Principal, the Superintendent and the Principal's employees, consultants, other contractors and agents will not be obliged to do or refrain from doing anything to enable the Contractor to reach Practical Completion before the Date for Practical Completion, and doing or refraining from doing anything to enable the Contractor to reach Practical Completion before the Date for Practical Completion is not a breach, act or omission by any of them.  The time for performance of the Principal's or the Superintendent's obligations shall not be affected by the Contractor's desire or attempts to reach Practical Completion before the Date for Practical Completion.  Please refer to the new deed ( General conditions of contract) for the full Recoding of contractors performance details 33.3 - Principal & superintendent not obliged to help finish early
  • 67. The Contractor falling behind the Construction Program under the new Deed AG4895/12 – (General conditions of contract)  If at any time the progress of the work under the Contract has fallen behind that shown in the latest construction program approved by the Superintendent or otherwise is not in accordance with the Contract, the Contractor shall at its own cost take the necessary corrective action so as to ensure that progress is maintained in accordance with the Contract.  Subject to Clause 32, such corrective action may include the working of overtime and additional shifts, the application of more resources to carry out the work and the adjustment and rescheduling of activities.   • 68. The Contractor falling behind the Construction Program under the new Deed AG4895/12 – (General conditions of contract)  The Superintendent from time to time may direct the Contractor to provide details of the corrective action it plans to take under this Clause 33.4.  If the Contractor fails to take corrective action in accordance with this clause, the Superintendent may direct the Contractor as to the corrective action it is to take and the Contractor shall comply with that direction at its own cost.
