3. What is bioengineered food?
• The most common reference for food produced
using biotechnology is GMO or genetically
modified organism.
• Generally, the reference includes not only the raw
agricultural products, such as corn and soybeans,
but also any food containing an ingredient from a
source that was also genetically modified.
• The issue of what is and is not a “GMO” for
purposes of food labeling can be complicated,
however.

4. What is bioengineered food?
• Do GMOs include food processed with genetically
modified enzymes?
• Do GMOs include food that contain no traces of
genetically modified genetic material?
• Do GMOs include food made from ingredients
that are derived from animals feed GMO feed?
• The answers to these questions are important to
a determination of what food may require a label

5. Current Regulatory Framework
• There is no federal law that mandates the
“automatic” labeling of food developed using
biotechnology.
• Food labeling is currently regulated under the Food
Drug and Cosmetic Act based “upon objective
characteristics of the food and the intended use of
the food (or its components)” without regard to “the
method by which it is developed.” Statement of
Policy: Foods Derived From New Plant Varieties, 57
Fed. Reg. 22,984 (May 29, 1992)
